General Conditions of Sale
1 – Cost
1.1 – The costs of our products are indicated in euros.
1.2 The costs of shipping and handling are additional. (see the page “Deliveries”)
1.3 – In the case of an order shipped to a country other than France, you become the importer of the work (or works) concerned. The customs duty or other local taxes or importation fees or state/federal taxes are possibly due. We are not liable for these fees and taxes. They will be at your expense and you are entirely liable for them, as well as for the terms of declaration of payment to authorities and competent organizations of your country.
1.4 – All orders, no matter their origin, are payable in euros.
1.5 – The works/paintings remain our property until complete payment has been received.
1.6 – We reserve the right to modify the costs and the conditions of sale without prior notice.
2 – ORDERS AND AVAILABILITY
2.1 – An email confirming and validating the order will be sent to the client after the verification of the availability and total payment of the works ordered. If said works have already been sold, the client will be reimbursed.

4.1 – The payment of your purchases will be made online, by credit card through a secure site, by bank transfer or by check.
5 – LIABILITY
5.1 – Under no circumstances will we be liable in the case of the deterioration (wear and tear) of the works or the delay of delivery. In this case, the client will be led to contact the transporter directly.
5.2 – The annotations and reproduced photographs illustrating the works are not contractual, and as a consequence, we are not liable in the case of error or incorrect representation of said works.
6 SATISFACTION OR REIMBURSEMENT
You have a period of 11 days (counting from when you receive your order) in order to return the product if you are not satisfied with it. (article L121-16 of the French consumer code). After that time, the cost of shipping and return will be at your expense. Only the price of the product or products will be reimbursed. Returns can be made to Frédéric Eymeri, 24 rue bellevue ,49120 Sainte Christine, France. This right to return applies only to complete products, in their original state, with a copy of the receipt of purchase, and the relevant customs documents. Returned articles which are incomplete, ruined, damaged, or dirty as a result of your negligence will not be taken back. If you choose to exercise the right of withdrawal, Frédéric Eymeri engages himself to reimburse you the entire sum spent, within 30 days of his reception of the products. The reimbursement will be in the form of a check in the name of the client who placed the order and the billing address. No kind of “cash on delivery” letter will be accepted, for whatever reason.
7 – CUSTOMER SERVICE
7.1 – The artist Frédéric Eymeri is the only negotiating partner with his clients.

8 – INTELLECTUAL PROPERTY
8.1 – Every reproduction or copy, in whole or in part, of the works by any means is strictly prohibited. The artist owns all the intellectual property rights of his works and every reproduction or copy.
8.2 – A certificate of authenticity with the handwritten signature of the artist, indicating the sale price, as well as the reproduction of the work, is delivered with each work.
9 – APPLICABLE LAW - LITIGATION
9.1 – The present contract is subject to French law.
9.2 –The language of the present contract is the French language.
10 – SPECIFIC COMMISION FOR THE CREATION OF A WORK
10.1 – The object of a specific commission for the creation of a work shall be free of every right of reproduction and will not be the object of a right to the image. The clients making the order are entirely liable and agree to verify and respect this clause.
10.1. The artist can not be held liable if this clause 10.1 was not respected by his client.
10.2 – The object of a specific commission shall respect in general: the moral sense, common decency and the human being. Every commission concerning the copy of a piece or works of art will be refused.
10.3 – The artist may, without any explanation, refuse his client every commission which does not inspire him, which is contrary to his style of painting, contrary to common decency or which does not respect the above clauses.
11 – NON-TRANSFERABLE INFORMATION
11.1 – We commit to not disclose to third parties any information you provide to us. This information will be confidential, and will only be used in connection with your orders.
